Alternate Tunings Not working properly

I just bought a JTV-59 2 days ago.  I had it shipped to Guitar Center and took it home in the box.  When I plugged it in and tried it out at home, some of the alternate tunings weren't set right.  Most notably for me the open D tuning was definatly NOT open D.  It seems that the 3rd and 6th string were WAY off and it was unplayable.  I think that DADGAD was off too.  I read through the directions and did a factory reset. This fixed the problem and everything was good.  I played for a while and then turned the guitar off and returned a few hours later to find the tunings all out again like when I first got it.  Again I re-read the directions and did the factory reset which fixed it.  When I turned it off and left it again for a while. same thing.  The tunings were horribly off.  After having the Axe for two days it seems that when I only leave the guitar off briefly, the settings stay but when I leave it for a while, they go out and need a reset.

 

When I demo-ed the Variax at the store I played both the JTV-69 and the JTV-59.  The 69 worked great but I remember that when I played the 59 several of the tunings were out the same way as my model.  I had assumed that someone else who had demoed the guitar had tried to do some custom tunings and had messed up the presets but now I think that there may be some kind of issue wtth the JTV-59 (or at least a batch of them).

 

The other thing that was strange is when I looked at the guitar, one of the screws from one of the back panels was missing.  I am wondering if my guitar was a refurb rather than a new one and that it was returned previously to the factory, reset and then sold again.

 

Please advise what I should do.  The guitar plays fine and sounds great after it is reset but I don't think I should have to do that every time I pick it up to play.

    If a factory reset temporarily fixed it and the problem came back, then the problem could be with the flash memory. The next step would be to reinstall the Flash Memory of the Variax. To do so follow the instructions at the link below:

    If the guitar still had a problem with the alternate tunings, then the hardware of the guitar will need to be assessed by the Line 6 Warranty Service Center, in which case you would need to obtain an RMA. For more information about obtaining an RMA for repair, follow the link below:

      Has anyone experienced this?  I was playing and all the sudden it forgot the tunings. "Standard" stayed the same,

      but the other altered tuning were all wrong...Drop D left the E unchanged and droped the A down a whole step...etc.

      Also, just a general wobblyness and crappy tone.

       

      I must say it doesn't engender much confidence in me for live usage of this guitar.

       

      How can this be fixed? 

       

      I guess I can go through and reprogram all the factory tunings, but what's to stop it from just doing it again in the middle

      of a session or God forbid a show?!.....Was going to use this on an upcoming tour but not sure now.
