Switches not working/Software update not going through

My 2 month old M9 decided to stop working as I went into a studio session with a major label artist. I can dial in one effect sound using the knobs and it presumes it's on effect 3A, but I cannot use any of the foot switches and also the Monkey application is not able to update the software for some reason.
I purchased this item brand new from a retailer on eBay and would like to know what my best bet is. I know there are service centers in the NYC area but I need this item sooner than later so an exchange would be best if that is possible at SamAsh or Guitar Center or something.
Any help please?
i at least got the software update. that did nothing to relieve switches not working. i embarrassingly just had the midi cables backwards so the update wasn't happening.

any advice on switches?

From time 1:00 to time 2:10 r3fx show exactly how the original switch looks and works compared to a heavy duty momentary switch! I`ve got the same problem with an 2nd handed M9 just bought, so this one is going to get a switch upgrade. Got two brand new M5`s as well on my main pedal board working perfect, but as soon as they start to trouble with me, the has to transform with a switch upgrade!!!
